The petitioner seeks bail in connection with Muffasil Motihari P.S. Case No.381 of 2016 registered under Sections 387 and 506 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, only it has come that the mobile, which was used in demanding the ransom and was belonging to one Satyendra Kumar Sah, was recovered from the possession of the petitioner. While the prayer of the petitioner for grant of bail was rejected earlier vide order dated 13.04.2017 passed in Criminal Misc.
Patna High Court Cr.Misc. No.62367 of 2017 (2) dt.24-01-2018 2/2 No.15028 of 2017 by this Court on merit but the petitioner, who has no criminal antecedent, is in custody since 09.10.2016 in the present case.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Muffasil Motihari P.S. Case No.381 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
