02. In the present case, the petitioner seeks bail in connection with Saksohara P.S. Case No. 28 of 2025 registered for the alleged offences under Sections 118(2), 109, 308(5), 324(4)+(5), 352, 351(2)+(3) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 25(1-b)a/26/27/35 of the Arms Act.

As per prosecution case, the petitioner along with his two associates came to the tea stall of the informant and when the informant demanded payment for articles supplied to them, they refused to pay and damaged the articles kept in the shop and also snatched Rs. 5,000/-. Thereafter, they assaulted the brother of the informant. After sometime, this petitioner
Patna High Court CR. MISC. No.55922 of 2025(5) dt.15-12-2025 2/3 came and fired upon the informant and the shot hit on his left thigh. The petitioner also hit him on his head with butt of the pistol.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The prosecution story is false and concocted and no occurrence in the manner as alleged has ever taken place. The injury reports of the victims show simple injuries caused by hard and blunt substance and injuries are mostly abrasions except for one lacerated wound of size 2" x 1" x 1⁄2" on left thigh on the person of the informant. Learned counsel further submits that no firearm injury was caused to anyone. The petitioner is in custody since 17.05.2025 and charge-sheet has been submitted. The petitioner is having antecedent of one case.
05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the simple nature of injuries of the victims and further considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten

No.55922 of 2025(5) dt.15-12-2025 3/3 thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Barh, Patna/court concerned in connection with Saksohara P.S. Case No. 28 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
