Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Adapur (Harpur) P.S. Case No. 210 of 2022, lodged under Section 394 of the Indian Penal Code.

As per prosecution, the case has been filed against the son of one Balmiki Giri alleging therein that he has looted Mobile of the informant.

Learned counsel for the petitioner submits that name of petitioner is figured in this case by virtue of confessional statement of co-accused Sanjay Giri. He further submits that no T.I.P. took place nor any incriminating has been recovered from

Patna High Court CR. MISC. No.56595 of 2022(2) dt.24-12-2022 2/2 the possession of petitioner. Learned counsel for the petitioner further submits that petitioner is in custody since 11.07.2022 having clean antecedent.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Raxaul at Motihari, East Champaran in connection with Adapur (Harpur) P.S. Case No. 210 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
