JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-04-2015 The matter has been listed under the heading "To Be Mention" at the instance of the petitioner to the extent that by inadvertently the case diary of Excise Case No. 30 of 2014 was called for vide order dated 20.02.2015 as it is a case lodged on basis of prosecution report and no case diary is available on record.

The petitioner is languishing in jail since 27.09.2014 in a case registered for the offences punishable under Section 47(a) of the Excise Act.

500 liters of mahua liquor and 800 kg of fermented mahua were recovered from the petitioner.

It is submitted by learned counsel for the petitioner that the seizure list does not depict the actual place from where the seizure has actually been made. A statement has been made in

Patna High Court Cr.Misc. No.46924 of 2014 (4) dt.03-04-2015 2/2 para 3 of the petition that the petitioner is accused in one other case registered under the provisions of Arms Act. Considering period under custody, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Excise Case No. 30 of 2014.
