Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 177, 181, 191, 193, 420, 467, 468 of the Indian Penal Code. The prosecution case is that the petitioner while contesting the Panchayat Samiti Election in the District of Supaul in the year 2006, deliberately suppressed the pendency of a criminal case against him.

It is submitted by the learned counsel for the petitioner that in the alleged criminal case, the petitioner has already been acquitted and the case has been lodged after nine years of the alleged cause of action.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the

Patna High Court Cr.Misc. No.38214 of 2015 (2) dt.24-09-2015 petitioner surrenders before the learned court below within a period of six weeks from today in connection with Pipra P.S. Case No. 49 of 2015, pending in the court of learned Sri J.Kumar, Judicial Magistrate, Ist Class, Supaul. With this observation this application is disposed of.
