This is an appeal under Section 14 (A) (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, against refusal of prayer for bail in Ram Nagar P.S. Case No.433 of 2017 instituted under Section(s) 419, 420, 467, 468, 471/34 Indian Penal Code and Section 3(ii)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Counsel for the appellant submits that there is specific allegation against Md. Dilshad and Rohit. Appellant is not named in the First Information Report. His name has come during investigation. Rohit Kumar has already been granted bail by a co-ordinate Bench of this Court by order dated 19.02.2018

Patna High Court CR. APP (SJ) No.1146 of 2018 (4) dt.24-05-2018 2/2 passed in Cr. Misc. No.4003 of 2018. The appellant is in custody since 02.12.2017.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the appellant, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 1stcum-Special Judge, SC/ST Act, Bettiah, in connection with Ram Nagar P.S. Case No.433 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner. Accordingly, the impugned order is set aside and the appeal is allowed.
