03.03.2015 Heard learned counsel for the parties.

The petitioner has to pay a price for indiscretion and his bona fide will have to be established in the trial. However, taking into consideration the statement of the victim girl that she has not been physically violated and the petitioner, therefore, has not exploited her during the period, the victim had spent time with him and now that she has returned to her parents. In view of the aforesaid facts and circumstances, bail application is allowed.

Let the petitioner, above-named, be enlarged on bail on furnishing bail bond of Rs. 20,000 /- (twenty thousand) with two sureties of the like amount each to the satisfaction of Sri Jitendra Kumar, J.M., 1st Class,

Patna High Court Cr.Misc. No.47639 of 2014 (2) dt.03-03-2015 2/2 Purnea, in connection with K. Nagar (Srinagar) P. S. Case No. 447 of 2014.

One of the two sureties will be blood relation and the other will be a government servant. Petitioner must ensure that he will not try to establish any contact with the victim or try to intimidate the witnesses or the informant. If such allegation or evidence thereof comes before the prosecution they are free to move the court below for cancellation of the bail.

The objection of the informant with regard to non-grant of bail is rejected in view of the reasons provided earlier.
