This is a case registered for the offence punishable under Sections 302 and 326/34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner's Counsel submits that out of same occurrence two First Information Reports were instituted and the petitioner is an accused in both the
Patna High Court Cr.Misc. No.55606 of 2017 (2) dt.12-12-2017 2/3 cases. The instant case relates to the offence punishable under Section 302 and allied sections of the Indian Penal Code. He submits that the allegation of inflicting Chhura blow against the victim is attributed to one Sanjeev Kumar. No overt act has been alleged against the petitioner, who is in custody since 08.01.2017.
The investigation in the case has already been completed and other than the two cases, referred to above, arising out of the same incident, there is no other antecedent of the petitioner.
In the facts and circumstances of the case, the prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on his furnishing bonds of Rs.
10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, District-Patna, in connection with Bakhtiyarpur P.S. Case No. 246 of 2007, subject to the conditions:
(i) That one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the
