Mr. Sri Chandra Bhushan Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-06-2018 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Ariyari (Kasar) P.S. Case No. 165 of 2017, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code and 3 /4 of the Dowry Prohibition Act. The allegation is regarding the accused persons having killed the victim girl on account of non fulfillment of the demand for dowry.

The learned counsel for the petitioners submits that the petitioners are the father-in-law and mother-in-law of the victim lady and the husband is already in custody, hence, no prejudice would be caused in case, the petitioners are granted

Patna High Court Cr.Misc. No.21201 of 2018(4) dt.28-06-2018 2/2 bail. It is further submitted that the petitioners are having a clean antecedent and they are languishing in custody since 13.02.2018.

Per contra, the learned counsel for the informant has vehemently opposed the prayer of bail.

Having regard to the facts and circumstances of the case as also the fact that the main accused i.e. the husband herein is in custody, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sheikhpura in connection with Ariyari (Kasar) P.S. Case No. 165 of 2017.
