The petitioner seeks bail in a case registered under Sections 341, 323, 326, 307, 354, 376, 498(A)/34 of the Indian Penal Code and Section-3/4 of Dowry Prohibition Act. Prosecution case in short is that the accused persons used to torture the informant for want of demand of dowry. It is further alleged that father-in-law of the informant gave her some sweets for eating and after eating of the same, she became unconscious. It is also alleged that father in law of the informant in her conscious state, committed rape upon her. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.52637 of 2019(4) dt.16-11-2019 2/2 petitioner is in custody since 24-03-2019. Charge sheet has already been submitted. The petitioner is husband. So far allegation in respect of offence under Section 307 of the Indian Penal Code is concerned, the same is alleged against co-accused Rinki Devi. There is no allegation of assault alleged against this petitioner nor any injury has been caused to the informant by this petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XV, Sasaram, Rohtas in connection with Sessions Trial No. 349 of 2019 arising out of Kargahar P.S. Case No. 375 of 2018.
