2. The present application has been filed seeking cancellation of the anticipatory bail granted to Opposite Party no. 2 vide order dated 03.04.2014 passed in Cr. Misc. No. 14306/2014 arising out of Bahadurpur P.S. Case No. 402 of 2013, registered under Sections 323/ 498a/ 504/ 506/ 34 of the I.P.C. and Sections 3/ 4 of the Dowry Prohibition Act.

3. Learned counsel for the petitioner submits that the opposite parties have allegedly violated the condition of bail by not complying with the direction of this Court regarding payment of monthly maintenance to the petitioner.

4. Accordingly, the present application stands disposed of with liberty to the petitioner to approach the court below, by filing an appropriate application on the aforesaid ground.

5. If such an application is filed, the same shall be considered and decided by the learned Magistrate concerned, in accordance with law, within a period of 15 days from the date of its filing, after affording an opportunity of hearing to all concerned parties. In the event of non-cooperation by any party, the learned Magistrate shall be at liberty to proceed ex parte in accordance with law.

6. If the learned Magistrate finds the allegations of the petitioner to be true, the bail bond of the O.P. No. 2 shall be cancelled forthwith.
