JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363 and 365/34 of the Indian Penal Code.
It is alleged that husband of the informant went traceless on 8.11.2015 when suspicion was raised against the petitioners since they were on inimical terms and they earlier gave threatening.
It is submitted by the learned counsel for the petitioners that in 164 Cr.P.C. statement the victim has stated that he has been fighting litigation since thirty years and though he was being abducted and taken to Punjab but on the way he got down from the
Patna High Court Cr.Misc. No.9172 of 2016 (2) dt.29-02-2016 2/2 train at Jamunapur railway station and went to house of his brother in law (sadhu). Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation levelled in the background of litigated relationship between the parties, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Saran at Chapra, in connection with Isuapur P.S. Case No.151 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
