JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 03-03-2015 Petitioner is in custody since 20.5.2014 in relation to Motihari Town P.S.Case No. 242 of 2014, pertaining to Trial No. 7662 of 2014, pending before the Chief Judicial Magistrate, Motihari.
Learned counsel for the petitioner submits that the petitioner was, in fact, a rag-picker and has been wrongly implicated in the present case.
Be that as it may, in the facts and circumstances, let the petitioner Kanhaiya Prasad be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Motihari Town P.S.Case No. 242 of 2014, subject to the condition that the petitioner would be personally present on each and every date before the trial court and if on any two consecutive occasions
Patna High Court Cr.Misc. No.47042 of 2014 (2) dt.03-03-2015 he is absent, the trial court would be at liberty to cancel his bail and take him into custody.
