The petitioner seeks bail in connection with Excise Case no. 425 of 2017 registered under Section 30(g) of Bihar Prohibition & Excise Act-2016.

The petitioner is said to have been vending toddy and 70 lts. toddy was recovered from his possession which was destroyed at the place of occurrence barring 1 lt. kept reserved as sample.

It is submitted by learned counsel for the petitioner that the petitioner has got licence issued by Excise Supt. Muzaffarpur, for extracting toddy which is valid upto 31.3.2018

Patna High Court Cr.Misc. No.584 of 2018 (2) dt.24-01-2018 2/2 and as per the aforesaid licence, he had extracted toddy and kept at the place of occurrence for transportation but in the meantime he was apprehended by the police along with the alleged toddy. He is not indulged in vending the toddy. He has no criminal antecedent. The petitioner has been languishing in custody since 16.11.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Excise Case no. 425 of 2017.
