The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,341,323,307,384,387,504 and 506 of the Indian Penal Code.
The prosecution case is of demanding extortion from the informant who is a doctor by the petitioner and others when co accused Shakti Singh and Amit Kumar resorted to fire when no injury was caused. When the informant's compounder came to rescue then he was also assaulted.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.37698 of 2015 (2) dt.18-09-2015 2/2 petitioner that in the background of land dispute and pending title suit the accusation has been levelled. Prior to the occurrence the petitioner lodged an informatory petition and there is counter version of the occurrence being Laheriasarai P.S. Case No. 307 of 2015. It is further submitted that neither any injury was caused to the informant nor any extortion amount was paid hence no case under sections 307, 384 and 387 IPC is made out. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Laheriasarai PS Case No. 303 of 2015 pending in the court of learned CJM, Darbhanga. This application is disposed of with the aforesaid observation/direction.
