JUSTICE ARUN KUMAR ORAL ORDER 12-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Barauni P.S.Case No. 452 of 2016 registered under Sections 8 and 20B of the Narcotic Drugs and Psychotropic Substances Act.

The case of the prosecution is that two persons were going on a motorcycle and seeing the police, leaving the motorcycle, escaped away after throwing air bag from which 6 Kg Ganja was found kept and the motorcycle is registered in the name of the petitioner .

Learned counsel for the petitioner submits that motorcycle was taken by the co-villager for personal use and he was not on the motorcycle and not apprehended at the spot and the quantity of

Patna High Court Cr.Misc. No.57844 of 2017 (2) dt.12-12-2017 2/2 ganja is not of commercial quantity rather only 6 kg and petitioner has been in custody since 01.09.2017 and has got no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Sanjit Singh is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act-cum-Sessions Judge, Begusarai in connection with Barauni P.S. Case No. 452 of 2016 with condition that one of the bailors must be his family relative and in case of absence on two consecutive dates without any medical urgency, his bail bond shall liable to be cancelled..
