The petitioner is in custody since 08.02.2018 in connection with Kazi Mohammadpur P.S. Case No. 63 of 2018 for the offence registered under Sections 147, 148, 149, 332, 333, 353, 452, 427, 307, 323, 324, 326, 379 and 120(b) of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the petitioner is general and omnibus in nature and, at best, he can be treated to be a member of the MOB. It is further submitted that similarly situated co-accused persons, who had assembled at the place of occurrence and had resisted the encroachment proceeding have since been extended the privilege

Patna High Court Cr.Misc. No.19960 of 2018 (3) dt.26-04-2018 of regular bail vide order dated 16.04.2018 passed in Cr. Misc. No. 20298 of 2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM, 1st East Muzuffarpur in connection with Kazi Mohammadpur P.S. Case No. 63 of 2018.
