JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 447, 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code and 3 / 4 of the Prevention of Witch Practices Act.
Allegation against the petitioners is that they termed the informant a witch, assaulted her and attempted to administer excreta to her. It is also alleged that they took away golden ear ring and chain amounting to Rs.20,000/-.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. Petitioners are close agnate and due to property dispute the present case has been instituted. There is no injury report to support the prosecution case. On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the
Patna High Court Cr.Misc. No.8249 of 2016 (2) dt.09-03-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IV, Motihari, East Champaran, in connection with Madhuban P.S. Case no. 363 of 2015 (G.R.
