The petitioner seeks regular bail in connection with Kuchaikote P.S. Case No. 289 of 2017 instituted for the offences under Sections 272, 273 and 420 of the Indian Penal Code and sections 30(a) (b) (c) of the Bihar Excise Prohibition Amendment Act, 2016.

The allegation is regarding recovery of 304 litres of illicit foreign liquor from the dickey of the car being driven by the petitioner.

The learned counsel for the petitioner submits that the fact is that he is not the owner of the car. The petitioner has a clean antecedent and he is in custody since 23.10.2017. Considering the nature of accusation, the period of

No.63311 of 2017 (2) dt.17-01-2018 2/2 custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge, Gopalganj in connection with Kuchaikote P.S. Case No. 289 of 2017.
