Patna High Court Cr.Misc. No.42827 of 2015 (2) dt.14-10-2015 State.

The petitioners being the maternal brother and younger brother of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after one year of the marriage for non fulfillment of dowry demand.

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general. The post-mortem reflects no external injury. The cause of death has not been ascertained by the Doctor as a result the viscera has been preserved. Though, it is alleged in the First Information Report that the daughter of the informant was throttled to death. Accusation is not specific against the petitioners.

Considering the thrust of accusation against the husband of the victim, who, is in custody and accusation is not being corroborated with the medical opinion, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial
