The petitioner seeks bail in a case registered for offences punishable under Section 30 (A) 41(i)/32(2) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 175.815 litres foreign liquor was recovered from the Bathan (Khaliyan) of the petitioner. It is further contended that there is no recovery from the personal possession of the petitioner and he does not have any connection with the alleged recovery of the liquor. Petitioner claims that he is having clean antecedent and is in custody since 09.09.2017, i.e., more than two months. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released

Patna High Court Cr.Misc. No.54896 of 2017(2) dt.23-11-2017 2/2 on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II-cum-Special Judge, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 220/17.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
