The petitioner apprehends his arrest in Islampur P.S. Case No. 137/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that the petitioners came to his shop on Maruti Car and brutally assaulted him and also snatched Rs. 40,000/- from his shop.

Learned counsel for the petitioner submits that nobody has supported the case of the prosecution. Some mutual scuffling took place, but from perusal of the case diary it appears that almost all the witnesses have stated that the petitioners came on Maruti Car assaulted the informant with fists, slaps and belt and

Patna High Court Cr.Misc. No.40991 of 2015 (3) dt.09-11-2015 2/2 fled away.

The informant got as many as two injuries one on head and another on chin.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order and the bail bond shall be disposed of after three months.
