JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-05-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Manjhi P.S. Case No. 2 02of 2017 for offences punishable under Sections 376 and 420 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner had allured the informant with the promise of marriage and established physical relationship with her.

Learned counsel for the petitioner submits that no offence under Section 376 I.P.C. is made out especially since both the persons are adult and consenting parties. The petitioner is said to be languishing in custody since 16th January, 2018 and is having a clean antecedent.

Patna High Court Cr.Misc. No.20640 of 2018 (3) dt.17-05-2018 2/2 Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bon of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chapra in connection with Manjhi P.S. Case No. 202 of 2017.
