JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 23-04-2015 Learned counsel appearing on behalf of the petitioners submits that the petitioner no.2, Lallan Das, has already been apprehended by the police and seeks permission to withdraw this application in respect of petitioner no.2, Lallan Das. Permission is accorded.
This application in respect of the petitioner no.2, Lallan Das, is dismissed as withdrawn.
Now, this application is surviving in respect of the petitioner nos.1, 3, 4 and 5 only.
Heard learned counsel for the petitioner nos.1, 3, 4 and 5 and the learned A.P.P. for the State.
Patna High Court Cr.Misc. No.47577 of 2014 (2) dt.23-04-2015 2/3 The petitioner nos.1, 3, 4 and 5 apprehend their arrest in connection with Garhpura P.S. Case No.62 of 2014 registered under Sections 148, 149, 323, 324, 364, 326(A), 379 and 307 of the Indian Penal Code.
The allegation is of tying with rope, dragging and assaulting the complainant-informant with an intention to kill him against the petitioners. It is also alleged that the petitioner no.2 poured acid over the body of the complainant-informant causing him burn injury on his back.
Learned counsel appearing on behalf of the petitioners submits that petitioner no.1, Lakshmi Das, is the maternal grand father of the petitioner no.5 (son of the petitioner no.4) and father of petitioner nos.3 and 4 and the petitioners have falsely been implicated in this case by the complainant-informant due to lodging of the case bearing Garhpura P.S. Case No.80 of 2013 by the petitioner no.1 against him under Sections 447, 341, 323, 325, 307, 504 and 506 of the Indian Penal Code. It is further submitted that the Complaint Case No.14264 of 2014 was filed by the complainant-informant on 24.06.2014 regarding the occurrence dated 14.06.2014, after ten days, on the basis of which the present F.I.R. was lodged.
Having considered the facts and the circumstances of
Patna High Court Cr.Misc. No.47577 of 2014 (2) dt.23-04-2015 3/3 the case, let the petitioner nos.1, 3, 4 and 5, above named, in the event of their arrest or surrender by them within four weeks, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Garhpura P.S. Case No.62 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
