JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 13-04-2015 Anticipatory bail application with regard to petitioner no. 1 has already been disposed of vide order dated 06.04.2015.
The petitioner no. 2 being the mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after six years of the marriage for non-fulfillment of the dowry demand.
It is submitted by learned counsel for the petitioner that the accusation is not specific. The post-mortem
Patna High Court Cr.Misc. No.47711 of 2014 (03) dt.13-04-2015 2/2 report does not suggest any injury and the viscera has been preserved when the victim died due to the abdominal pain for which she was provided medical assistance.
Considering the thrust of accusation against the husband of the victim and the post-mortem reflects that the cause of death has not been ascertained, let the above named petitioner no. 2 be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Chandi P.S. Case No. 32 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
