The petitioner seeks bail in Rajnagar P.S. Case No. 320 of 2017 registered under Sections 468, 420, 471, 401, 411 and 414/34 of the Indian Penal Code.

Stolen motorcycle is said to have been recovered from the possession of the petitioner and one other co-accused Vikki Kumar. On the basis of the confessional statement of the petitioner and other accused persons, five motorcycles were recovered from the possession of several persons. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. As a matter of fact, the petitioner happens to be student of Sriram

Patna High Court Cr.Misc. No.16824 of 2018 (3) dt.17-05-2018 2/2 Polytechnic College and was driving the motorcycle in question taking it from Vikki Kumar who is sitting on the said motorcycle as pillion rider out of curiosity without any knowledge of the said motorcycle to be stolen one. Though confessional statement of the co-accused has been recorded by the police, but confessional statement recorded by the police has no evidentiary value in the eye of law. He has no criminal antecedent. He has been languishing in custody since 01.01.2018. Other co-accused, namely, Ram Kripal Yadav and Santosh Kumar Chaudahry have been enlarged on bail by different co-ordinate benches of this court in Cr. Misc. No. 13957 of 2018 vide order dated 03.05.2018 and Cr. Misc. No. 16436 of 2018 vide order dated 02.05.2018 respectively.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II, Madhubani in connection with Rajnagar P.S. Case No. 320 of 2017.
