The petitioner is apprehending his arrest in connection with Rahui P.S. Case No. 374/2014 for the offence instituted under Sections 341, 323, 308, 379, 504 and 506/34 of the IPC.
The prosecution case, in brief, is that while the informant on 07.12.2014 at about 9.00 P.M. was returning home, accused petitioner and others who were in intoxicated stage started abusing and assaulting the informant and petitioner Santosh Singh put him down and with intent to kill him, badly assaulted on his abdomen and chest and co-accused Sanjeet Ram (son of Shiv
Patna High Court Cr.Misc. No.39428 of 2015 (2) dt.29-09-2015 2/2 Shankar Ram) took out Rs.15,000/- from the pocket of the informant.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner has falsely been implicated in the present case. Annexure-2 to the supplementary affidavit is the injury report which shows that the nature of injury is simple. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Rahui P.S. Case No. 374/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharshariff, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
