2. The petitioner has preferred this application for grant of regular bail in connection with Beldaur P.S. Case No. 178 of 2021 dated 13.8.2021 registered for the offences punishable under Sections 147, 148, 149, 342, 120B, 307, 302 and 504 of the Indian Penal Code and Section 27(3) of the Arms Act.
4. As per the prosecution case, the petitioner alongwith other co-accused persons entered the house of the informant and shot the father and the uncle of the informant dead and also caused firearm injury to another uncle of the informant. The co-accused Sita Devi exhorted to shoot Pappu
2/4 Kumar, Amal Kishore Singh and Nawal Kishore Singh fired on the chest of Pappu Kumar. The co-accused Dilchan Singh and Raushan Singh fired on Dhananjay Singh, who died on the spot.
5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to previous enmity. It is further submitted that the informant has lodged the present case against 20-25 persons and also name of 20 persons have been mentioned in the F.I.R. It is further submitted that from perusal of the F.I.R., it appears that all the co-accused persons including the petitioner fired on the informant's father and the uncle which hit on different parts of the persons of the deceased. There is no motive mentioned in the alleged offence. It is further submitted that in the F.I.R., no source of identification has been mentioned and how the informant identified 20 F.I.R. named accused persons by their names, father's name and address. There is land dispute between the parties.
There is general and omnibus allegation against the petitioner and the other co-accused. Nothing incriminating material has been recovered from the conscious possession of the petitioner. It is further submitted that the other co-accused persons, Ranvir Singh @ Feni Singh in Cr. Misc. No. 40209 of 2023 vide order dated 24.07.
3/4 Kishore Singh in Cr. Misc. No. 68084 of 2022 vide order dated 08.02.2023, Sita Devi in Cr. Misc. No. 16347 of 2022 vide order dated 23.08.2022 and Dilchan Singh @ Dilchan Prasad Singh in Cr. Misc. No.24225 of 2022 vide order dated 23.08.2022, Indal Mandal @ Indal Kumar in Cr. Misc. No. 1724 of 2024 vide order dated 24.01.2024 and Sonu Mandal @ Sonu Kumar in Cr. Misc. No. 61158 of 2024 vide order dated 12.09.2024 have already been granted bail by a Bench as well as the Co-ordinate Bench of this Court, annexed as Annexures- 2, 3, 3/A, 4 and 5 to the present bail application. The petitioner has one criminal antecedent in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 29.01.2025.
6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Class, Khagaria in connection with Beldaur P.S. Case No. 178 of 2021 with further condition:- I. The petitioner is directed to remain
4/4 physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
