The petitioner is in custody since 18.12.2017 in connection with Ballia P.S. Case No. 228 of 2015 for the offence registered under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is wholly fabricated and in fact, the first information report has been lodged after a delay of two days, though the informant could have well lodged the same on the same day. It s further submitted that there is no specific allegation against the petitioner. It is further submitted that there is previous enmity between the petitioner and the deceased family and the entire allegation is malicious and an afterthought. It is
Patna High Court Cr.Misc. No.21746 of 2018 (3) dt.07-05-2018 2/2 further submitted that similarly situated co-accused person, namely, Chullo Singh has since been extended the privilege of bail vide order dated 15.11.2016 passed in Cr. Misc. No. 38855 of 2016.
Considering aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusari in connection with Ballia P.S. Case No. 228 of 2015.
