The petitioner seeks bail in Vaishali P.S. Case No. 436 of 2019, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 446 litres of foreign liquor has been recovered from field near the poultry farm of co-accused Dinesh Kumar Singh. It is submitted that name of this petitioner has come in this case on the basis of confessional statement of co-accused Tinku Kumar. No recovery has been made from conscious possession of this petitioner. The said poultry farm and field does not belong to this petitioner and has got no concern with the seized liquor. Petitioner is in custody since 03.07.2021.

Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent of similar nature.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Excise Court, Vaishali at Hajipur in connection with Vaishali P.S.
