The petitioner apprehends his arrest in connection with G-1-II Case No. 48 of 2014 registered for the offence under Sections-47(A)(D)(F) of the Excise Act.

According to prosecution case itself, the alleged recovery was made from the house of co-accused, Oshier Yadav, who happens to be son of the petitioner.

The contention on behalf of the petitioner is that the petitioner is separate from the co-accused, Oshier Yadav who resides in his newly built house, from where the alleged recovery was made and moreover, the petitioner does not have any criminal

Considering the aforesaid submissions as well as facts and circumstances of the case as, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with G-1-II Case No. 48 of 2014 to the satisfaction of Learned Chief Judicial Magistrate, Siwan subject to conditions as laid down u/S 438(2) of the Code of Criminal Procedure.
