The petitioner seeks bail in a case registered for the offence under Sections 147,148,149,353,307,120(B) of IPC, Section 3/4 of Explosive Substance Act and 17 of C.L.A. Act. Earlier the prayer for bail of the petitioner was refused vide order dated 20.04.2017 and 28.02.2018 passed in Cr. Misc. No.14445 of 2017 and Cr. Misc. No. 60857 of 2017. Vide order dated 12.01.2023, a report was called for with regard to the present status of the trial. Report of the learned Trial Court dated 21.01.2023 reveals that out of eight prosecution witnesses, five witnesses have been examined and rest three witnesses have to be examined.

Considering the aforesaid facts, the trial is at the verge

Patna High Court CR. MISC. No.56653 of 2022(3) dt.27-02-2023 2/2 of conclusion, I am not inclined to enlarge the petitioner on bail in connection with S.Tr.No.54 of 2018 arising out of Dumariya P.S.Case No.22 of 2014 pending in the court of learned Additional Sessions Judge-III, Gaya.

Prayer is refused.

However, the learned Trial Court is directed to expedite the trial.
