2. The petitioner seeks bail in a case registered for the offence punishable under Sections 365, 504, 323/34 of the Indian Penal Code and subsequently Sections 302, 201 of the IPC has been added.
3. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that an unidentified corpse of a woman was recovered which has cut marks on both legs, hands and neck and uptil now the dead body has not been identified. He submits that there is no eye witness of the occurrence and only on suspicion, the petitioner has been made accused. He submits that there is no specific overt act against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of
Patna High Court CR. MISC. No.57690 of 2023(10) dt.10-04-2024 2/2 the bail application and he is languishing in judicial custody since 31.05.2023.
4. Learned APP for the State opposes the prayer for bail.
5. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Banmankhi P.S. Case No. 63 of 2021.
