The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 290 of the Indian Penal Code and 47(a) of the Excise Act. From the motel of the petitioner several empty liquor bottles as well as foreign liquor were recovered from the premises of the motel.

It is submitted by learned counsel for the petitioner that from the rooms of the motel only empty bottles were recovered. It is further submitted that the FIR was registered on 01.11.2015 but the same reached to the court of learned CJM on 07.11.2015 which reflects by antedating the FIR has been registered.

No.10287 of 2016 (2) dt.03-03-2016 2/2 Let the learned court below consider the prayer for regular bail of the petitioner keeping view of the delayed reaching of the FIR to the learned court below, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Basopatti P.S. Case No. 140 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Madhubani.
