The petitioner is apprehending arrest in a case registered for the offences punishable under section 47(a) of the Excise Act.

The police raided the manufacturing unit and recovered 20 liters of country made liquor and 500 Kgs. Of fermented materials for preparing country made liquor. The petitioner is alleged to have escaped from the place of raid after seeing the police.

It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled

Patna High Court Cr.Misc. No.41932 of 2015 (2) dt.13-10-2015 2/2 and nothing has been recovered from the possession of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Excise Act Case No.19 of 2006 (Trial No. 480 of 2014) pending in the court of learned SDJM, Raxaul, East Champaran at Motihari.

This application is disposed of with the aforesaid observation/direction.
