The petitioner is in custody in connection with Beldaur P.S.Case No.183 of 2017 registered for an offence under the Arms Act.

It is alleged that SHO conducted raid at the house of this petitioner and apprehend him and his brother. It is further alleged that from the possessing of co-accused, a country made fire arm was recovered. However, police allegedly seized three cartridges from the possession of the petitioner. Petitioner is in custody since 17.09.2017 having clean antecedent except a case bearing Beldaur P.S.Case No.195 of 2016 which relates to land dispute. The seizure list does not bear signature of any independent witnesses. Learned APP opposed the submission.

Patna High Court Cr.Misc. No.63248 of 2017 (2) dt.11-01-2018 2/2 Considering the aforesaid facts and circumstances, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Khagaria in connection with Beldaur P.S.Case No.183 of 2017.
