JUSTICE RAKESH KUMAR ORAL ORDER 16-11-2017 Heard Sri Shrikant Pandey, learned counsel, assisted by Sri Mukesh Kumar, learned counsel for the petitioner and Smt. Gulnar Begum , learned Additional Public Prosecutor. The sole petitioner, who is in custody since 13.8.2017 with clean antecedent in Singhia P.S. Case No. 118 of 2017, registered for the offence under Section 30(a), 38(1), 38(2), 41(1) of the Bihar Prohibition And Excise Act , 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner is innocent and due to mistake he was made accused in the present case. He submits that petitioner being passenger had occupied a Pick Up Van and he was not having any knowledge as to whether in the Pick UP Van there was any liquor or not, but subsequently the said Pick Up Van was

Patna High Court Cr.Misc. No.55285 of 2017(2) dt.16-11-2017 2/2 intercepted and from the said Pick Up Van huge quantity of Indian make foreign liquor was shown recovered and petitioner being only occupant of the vehicle has been made accused , arrested and languishing in jail since 13.8.2017. In view of the facts and circumstances particularly clean antecedent and period of custody , let the petitioner Raja Ram Yadav @ Raja Ram be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge - cum - Special Judge, Excise, Samastipur / concerned court in connection with Singhia P.S. Case No. 118 of 2017 .
