Petitioner is an accused in a case registered for offence under sections 395, 397 IPC.
Learned counsel for the petitioner submits that the petitioner has been implicated in this case on the basis of political rivalry. He claims parity with the co-accused Fulan Yadav who has been allowed bail vide order dated 20.9.2017, passed in Cr.Misc.No. 42593 of 2017. Petitioner is in custody in connection with this case since 22.2.2018. In view of the fact that said Fulan Yadav has been allowed bail after remaining in custody for six months, let the court below release the petitioner in the instant case on bail after remaining in custody for six months on the following conditions:- (a) One of the bailors will be a close relative of the
Patna High Court Cr.Misc. No.22059 of 2018 (4) dt.22-05-2018 2/2 petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.
(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
The bail petition is disposed of.
