The petitioner seeks anticipatory bail in connection with Ghosi P. S. Case No. 160 of 2015 registered under Sections 399, 402, 385 and 387 of the Indian Penal Code and Sections 16, 18, 20 and 21 of the Unlawful Activities (Prevention) Act, 1967. According to the prosecution case, on confidential information, the police raided the house of the petitioner from where six miscreants started to flee away, who were chased by the raiding party but, they managed to escape. However, two persons, who were seen at the roof of the petitioner's house, were apprehended by the police personnel and on query they disclosed

Patna High Court Cr.Misc. No.42303 of 2015 (2) dt.08-10-2015 2/2 their names as Chandeshwar Rajak and Surendra Manjhi. On search, one country-made loaded pistol and two cartridges are alleged to have been recovered from the possession of co-accused Chandeshwar Rajak and one country-made pistol and seven live cartridges are alleged to have been recovered from the bag of coaccused Surendra Manjhi. On query, they disclosed that they are members of banned organization and they had gathered in the house of the petitioner to attack on the police station in order to loot the firearms.

Taking into consideration the serious nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the application is rejected. (Ashwani Kumar Singh, J.) Kanchan/- U T
