The petitioner is in custody since 08.10.2017 in connection with Chautham P.S. Case No. 122 of 2017 for the offence registered under Sections 302/120(b)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the entire allegation against the petitioner is based on suspicion and there is no material in the case diary to implicate the petitioner in connection with the present case. It is further submitted that there is no eye witness to the occurrence and the petitioner was not at all known to the deceased.

Learned counsel for the State, after perusal of the case diary, submits that save and except the suspicion, there is no further material in the case diary to implicate the petitioner in connection with the present case.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Khagaria in connection with Chautham P.S. Case No. 122 of 2017.
