2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 125 ( b ), 109, 103 (1) , 352, 351 ( 2 ) and 3 (5) of BNS. 3 . The prosecution case in brief, is that informant namely Nehal Qureishi alleged that on 11.05.2025 , all the F.I.R. named accused persons along with 10 unknown persons assaulted brother of informant and when informant objected, then co-accused persons assaulted informant with lathi and danda due to which he sustained injury . It is further alleged that brother of informant died during course of treatment and informant is still undergoing treatment.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.57436 of 2025(2) dt.02-09-2025 2/3 petitioner is not named in the F.I.R. The name of the petitioner transpired during course of investigation . The only material that has come against this petitioner is that the alleged occurrence took place on a land which is registered in the name of this petitioner and except this, there is no other material to show the complicity of this petitioner in the alleged occurrence . It is further submitted that on the alleged date of occurrence , this petitioner was not present on the spot and has got no concern with the alleged occurrence . Only due to local rivalry and political vendettas, this petitioner has falsely been made accused in this case .
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Saran at Chapra in connection with Chapra Nagar P.S. Case No. 250 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita ,
