JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-08-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Excise Case No. 444 of 2019 for the offenses under Sections 2(e), 3,5 & 13 of the Bihar Prohibition and Excise Act, 2016 (Mahua Flower Act,2006).

In the instant case 150 Kg Mahua is alleged to have been seized.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 16.07.2019.

Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged

Patna High Court CR. MISC. No.52973 of 2019(2) dt.29-08-2019 2/2 on bail on furnishing bail bond of Rs. 25,000/-(Twenty five Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Gaya in connection with Excise Case No. 444 of 2019, subject to deposit of Rs. 25,000/- cash in the court below.

The deposit of cash of Rs. 25,000/- shall abide by the final outcome of the pending criminal case.
