The petitioner seeks regular bail in connection with Thawe P.S. Case No. 180 of 2017 instituted for the offences under Sections 30(a), 35 and 38 of the Bihar Excise Amendment Act, 2016.

It is alleged that 52 litres of illicit liquor was recovered from the motorcycle of the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent and he is in custody 26.11.2017.

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner is

No.63367 of 2017 (2) dt.17-01-2018 2/2 having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge (Excise), Gopalganj in connection with Thawe P.S. Case No. 180 of 2017.
