The petitioner seeks bail in a case for the offence punishable under Sections 341, 329, 324, 447 and 307 of the Indian Penal Code and Section 27 of the Arms Act. The allegation against the petitioner is to have shot fire upon the informant which caused injury. It is submitted that the occurrence took place between both the parties and there is case and counter case between both the parties. The accused Sunil Kumar Singh has also lodged Mahua P. S. Case no. 294 of 2014 for the offence punishable under Sections 341, 323, 447, 504, 379 and 307 of the Indian Penal Code against the informant and his relatives. It is further submitted that there is no intention to cause death as no repetition of fire arms was made. The petitioner is in custody since 28.7.2014 having no criminal antecedents.

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.49115 of 2014 (4) dt.18-03-2015 2/2 each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Mahua P. S. Case no. 293 of 2014 with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
