JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-05-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 467, 468, 471, 129(B) of the Indian Penal Code.

As per the prosecution case, this petitioner was, allegedly, appointed as a teacher on the basis of forged certificate of qualification.

Learned counsel appearing for the petitioner submits that petitioner has already been terminated from service and is ready to refund the emoluments received during tenure as teacher in 18 monthly instalments.

Learned counsel appearing for the Vigilance opposes the prayer for anticipatory bail bail.

No.67112 of 2021(2) dt.25-05-2022 2/2 Considering the facts of the case and that the petitioner is a female and mother of small children, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Munger in connection with Kharagpur PS case No.263/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C., as well as condition that petitioner shall fully co-operate with the investigation and trial of the case failing which the court below shall be at liberty to cancel the bail bond of the petitioner as also with condition that petitioner shall refund the amount in 18 monthly installments, which shall be subject to final result of the case, receipt of first refund of 10% amount shall be deposited at the time of furnishing bail bond.
