Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

There is no eye-witness of the occurrence of murder either in the FIR or before the police. Only suspicion is there against the petitioner.

In view of the aforesaid material, in my view, the petitioner need not be further detained as under trial prisoner when the investigation is already complete and the petitioner is ready to cooperate with the trial.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

Patna High Court Cr.Misc. No.756 of 2018 (3) dt.20-02-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Jainagar Police Station Case No. 268 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
