SINHA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case for the offence under Section 365 of the Penal Code registered against unknown. He has been named in the statement of the victim boy recorded under Section 164 Cr.P.C. as the one who asked the victim boy to visit the lady visitor in the village so that he may purchase gold ornament from her. Victim boy never visited the lady on the instruction of the petitioner, rather on the next day he went to meet the lady at the instance of one Shrawan Kumar Yadav and thereafter kidnapped. Petitioner is the covillager of the victim boy and his antecedent is absolutely clean. Let petitioner, named above, surrender in the court
Patna High Court Cr.Misc. No.48437 of 2014 (3) dt.21-05-2015 2/2 below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and thereafter be released on bail on furnishing bail bond of Rs. 5,000/-(Rs. Five Thousand Only) with two sureties of the like amount each to the satisfaction of A.C.J.M., Naugachia in connection with Gopalpur P.S. Case No.106/2014, corresponding to G.R. No. 343/2014, subject to the conditions laid down under Section 438(2) Cr.P.C.
