====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case registered for the offence under Sections 379, 436 and other allied sections of the Indian Penal Code and Sections 3/ 4 of the Prevention of Witch Practices Act. He is named in the First Information Report along with Chhakni Paswan, who has already been admitted to the privilege of bail in the event of arrest in the said case under order no.2 dated 13.08.2015 passed in Cr. Misc. No. 32386 of 2015, Annexure-2.

It is submitted on behalf of the petitioner that his case is exactly similar to that of Chhakni Paswan, as in his case allegation with regard to section 379 of the Indian Penal Code is only ornamental.

Patna High Court Cr.Misc. No.41485 of 2015 (2) dt.16-10-2015 2/2 Let petitioner above named surrender in the court of S.D.J.M., Uda-kishunganj, Madhepura in connection with Alamnagar P.S. Case No. 75 of 2014 within four weeks from the date of receipt/ production of a copy of this order in the court below and thereafter his case be examined in the light of order dated 13.08.2015, Annexure-2 and if his case is similar to that of Chhakni Paswan, he be allowed similar treatment. Until examination of the case of the petitioner, no coercive steps be taken against him.
