JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-03-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners and other F.I.R named accused are said to have kidnapped the informant but having got information regarding the aforesaid kidnapping, the father of the informant came to his rescue and after that, petitioners are said to have opened fire but luckily the informant 's father escaped from that firing.

Submission on behalf of the petitioners is that the present case has been brought in retaliation to Bihar P.S.Case No. 607 of 2015 and, as a matter of fact, it was prosecution party, who caused firearm injury to one co-accused Karu Kumar, who,

Patna High Court Cr.Misc. No.10466 of 2016 (2) dt.08-03-2016 2/2 subsequently, lodged the aforesaid Bihar P.S.Case No. 607 of 2015.

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Bihar P.S.Case No. 606 of 2015.
