Earlier prayer for bail of the petitioner was rejected by this court vide order dated 30-10-2015 passed in Cr. Misc. No. 40794 of 2015.

This is the third attempt on behalf of the petitioner for grant of bail.

Taking into account that the petitioner is the main assailant causing fire-arm injury on the head of the deceased. A report was called for from the court below regarding the stage of the case.

It has been reported that out of 17 charge sheeted witnesses, 9 prosecution witnesses have already been examined and the trial is expected to be concluded within a period of six

Patna High Court Cr.Misc. No.3362 of 2018 (3) dt.04-04-2018 months from the date of receipt/production of the order. The prayer for bail is rejected.

The trial court is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of the order.

The District Magistrate and the Superintendent of Police, Banka are directed to ensure that the prosecution witnesses are produced on the date fixed by the trial court. It would not be out of place to mention that similar direction was made to the District Magistrate and the Superintendent of Police, Banka vide order dated 08-02-2017 passed in Cr. Misc. No. 54727 of 2016 but in spite of the said direction the trial is still pending.

Let the copy of this order be communicated to the District Magistrate and the Superintendent of Police, Banka for needful.
